Small Cell Wireless Deployment

This page contains information to guide the public and applicants in connection with wireless structures which may be proposed to be located in the right-of-way jurisdiction controlled by the City of Richmond, Indiana.  Terminology used on this webpage and in the guidelines may differ depending on the location and nature of each submitted proposal and upon the personal wireless service equipment proposed to be installed.  Definitions are located in IC 8-1-32.3-1 et seq.

Process

Applications for each proposed right-of-way excavation location are reviewed by the Public Works and Engineering Director on a case-by-case basis, with additional local review as necessary by Richmond Power and Light, the Richmond Zoning and Permits Division, the Richmond Police Department, the Richmond Fire Department, the Richmond Sanitary Department, and the Richmond Law Department.  Initial contact is made through Director Greg Stiens unless co-location on an RP&L pole is requested at the outset.

Applicants are encouraged to first consider co-locating proposed structures on utility poles operated by Richmond Power and Light in lieu of excavating the right-of-way.  To discuss, please contact the Richmond Power and Light Engineer Skip Moore.

Home owners associations or neighborhood associations that wish to receive notice of any applications filed in an area within their jurisdiction may contact the City Planner. Any notifications sent by United States postal mail will be charged in accordance with IC 5-14-3-1 etseq.  However, in addition to physical notifications, it is the goal of the City to make each complete application accessible on the City’s website, within three (3) to seven (7) business days of receipt by the City.  Additionally, the City Planner and the Public Works and Engineering Director may coordinate and schedule a technical review meeting with relevant association liaison and any applicant, as well as any other safety, zoning, or legal staff as necessary.

State and Local Laws

The nature of the location will determine the types of local review which may be involved.  Review is completed with recognition of the Federal Communications Commission regulations related to the 1996 Telecommunications Act which states, in part, that state municipalities may not regulate personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent the same comply with FCC regulations. IC 8-1-32.3-1 etseq. and other provisions are discussed in the application and guideline form discussed and linked below.
