154.22 R-3 ONE TO EIGHT FAMILY RESIDENCE DISTRICT
154.22.00 PRINCIPAL PERMITTED USES
No building, structure or land shall be erected, altered, enlarged or used which is arranged or designed for other than one of the following uses, except as provided herein and in 154.16.
154.22.00.01 General
Any use permitted and as regulated in the R-2 District except as modified herein, but not including agriculture.
154.22.00.02 Residential: Two-, three-, four-, five-, six-, seven-, and eight-family dwellings.
154.22.01 SPECIAL USES
The following uses may be allowed as special uses by Ordinance of the Common Council of the City of Richmond in accordance with the provisions of 154.48 hereof.
154.22.01.01 General: The Special Uses permitted and as regulated in the R-2 District, except as modified herein.
154.22.01.02 Administrative Business Offices, Professional Offices:
(a) Definitions
(1) “ADMINISTRATIVE AND BUSINESS OFFICE” - An administrative business office, not dependent upon over-the-counter sales for the operation of the business at the property in question.
(2) “PROFESSIONAL OFFICE” - An office, not dependent upon over-the-counter sales for the operation of the business at the property in question, where services commonly considered as professional are offered to the public.
(b) Intent
It is the intent of this Ordinance to allow Special Uses in existing structures in R-3 and R-4 districts for the purpose of preventing the physical deterioration of certain structures and neighborhoods; as well as helping to maintain a neighborhood in its present state when in good repair. It is intended to apply benefits of this Ordinance predominantly to the structures in the near downtown areas of Richmond.
(c) General requirements of petition and special use
(1) The petitioner for such a Special Use shall submit five (5) copies of a notarized affidavit of its proposal including the following:
(A) Off-Street parking plan
Showing the location of off-street parking, parking stalls, traffic flow, and entrances and exits thereto, in such a manner to serve the health, safety and general welfare of the neighborhood.
(B) Landscaping
Showing how the parking area will be shielded from the view of adjoining properties and how the front, rear, and side yards will be landscaped.
(C) Structure Improvement Plan
Showing how the structure will be renovated when necessary, and altered to accommodate the proposed Special Use while preserving the exterior structure without damaging the architecture of the building or preventing its future uses for residential purposes.
(2) Petitioner shall submit data on all planned uses in the subject structure. Uses other than those submitted with the petition may be added thereafter only after submission of another Special Use petition under this Ordinance.
(3) The granting of a Special Use under this Ordinance shall not prohibit other permitted uses pursuant to the applicable Zoning classification.
(4) Signs
Each Use granted for a structure pursuant to this Ordinance will be permitted a plaque, on the front of the structure not to exceed one (1) square foot or 144 square inches. No lighted signs will be permitted. No additional signs other than traffic signs shall be permitted.
(d) A Special Use granted pursuant to this Ordinance shall be subject to such conditions concerning off-street parking, landscaping, structural improvement or other conditions or restrictions which the Commission may recommend and the Council may provide in accordance with 154.48 of the said Zoning Ordinance. The Planning Department of the
City of Richmond shall inspect each property on a quarterly basis for adherence to the affidavit and other conditions and restrictions until such time as the improvements to the property have been completed. No person shall continue to use the property in question pursuant to a Special Use granted under this Ordinance after such time that said person is not in compliance with his proposal or other conditions or restrictions the Plan Commission may recommend and the Common Council may provide. Any such continued use shall constitute a violation of the Zoning Ordinance of the City of Richmond, Indiana. (Ord. 2987-1975)
154.22.01.03 Intent
There are areas within the City of Richmond designated as Historic Districts by the National Register of Historic Places. The restoration and reclamation of these areas is well underway and it is vitally important to the community that these efforts continue.
In recognition of the fact that a mix of commercial and residential land use was important historically to the development of these districts, it is the intent of this article to promote a commercial residential land use mix calculated to benefit the continued growth of these districts and to promote the health, safety and general welfare of the community while maintaining a primarily residential character.
(a) Special uses
The following commercial uses within the confines of the areas designated as Historic by the National Register of Historic Places and shown on the map located in the Department of Planning and Redevelopment labeled Exhibit “A”.
(1) Antique shops
(2) Art galleries
(3) Candle shops
(4) Candy, ice cream and sandwich shops
(5) China and glassware stores
(6) Tobacco shops
(7) Recreation or replicas of early Richmond industries or businesses in character within the historic setting, such as:
(A) Blacksmith shop
(B) Cooperage
(C) Tavern
(D) Gold or Silversmith
(E) Tinsmith
(F) Restaurant
(b) Goods and services
The range of goods and services to be provided by a proposed business shall be
presented as a part of the Special Use request before the Plan Commission and Common Council to enable both bodies to evaluate the impact of each proposed use on the character of the Historic District and the health, safety and general welfare of the Richmond community.
(c) Parking
Off-street parking may not be required. However, if off-street parking is provided, it shall be constructed in accordance with 154.41 of the Zoning Ordinance and with such other conditions as the Plan Commission may recommend and the Common Council adopt.
(d) Storage and display
Outside storage and display shall not be permitted except: this section shall not be construed to prohibit benches and chairs which may be provided on private property for the convenience of shoppers and tourists.
(e) Business signs
Each permitted Special Use shall be entitled to a fascia sign, with indirect lighting only, not exceeding six (6) square feet. Additional lettering may be permitted upon windows. Signage plans shall be presented at the time the Special Use is requested, showing all particulars. (Ord. 84-1981)
154.22.03 ACCESSORY USES
Accessory uses, buildings or structures customarily incidental to any aforesaid principal or special use, shall be permitted in conjunction with such use, including the following:
154.22.03.01 General
The accessory uses or structures permitted and as regulated in the R-2 District, except as modified herein.
154.22.03.02 Gardening
Gardening and the raising of vegetables or fruits exclusively for the use and personal enjoyment of the occupants of the principal building and not for commercial purposes.
154.22.03.03 Certain beauty parlors and barber shops
Beauty Parlors and Barber Shops, provided that such Beauty Parlors and/or Barber Shop is conducted only within a dwelling by only one (1) resident thereof without any assistants and such use is clearly secondary to the use of the dwelling for living purposes, does not change the character thereof, and is without exterior evidence thereof other than a one (1) foot square nameplate,
and does not involve the keeping of a stock-in-trade in connection therewith; and provided further that not more than one fourth of the area of one (1) floor of any such dwelling is devoted to such use. (Ord. 2-1981)
154.22.03 HEIGHT REGULATIONS
One-family and two-family dwellings shall not exceed two-and-one-half (2-1/2) stories or thirty (30) feet; other principal structures shall not exceed four (4) stories or forty-five (45) feet; accessory structures shall not exceed one (1) story or fifteen (15) feet except as provided in 154.51.
154.22.04 LOT AREA, FRONTAGE AND YARD REQUIREMENTS
The following minimum requirements shall apply except as provided in 154.50-154.54.
