154.30 C-1 LIMITED COMMERCIAL DISTRICT
154.30 C-1 LIMITED COMMERCIAL DISTRICT (Ord. 59-1981)
154.30.00 PRINCIPAL PERMITTED USES
No building, structure or land shall be erected, altered, enlarged or used which is arranged or designed for other than one of the following uses, except as provided herein and in 154.16.
154.30.00.01 General
Any use permitted and as regulated in the R-4 District except as herein modified.
154.30.00.02 Intent
The C-1 District is intended to provide for a wide range of commercial uses and services which, because of their particular nature, can locate adjacent to a residential district without detracting from the quality of life and the property values of the residential area, and provide for a complimentary mix of service and retail uses calculated to encourage vitality within the commercial district.
154.30.00.03 Retail and service uses as follows: (Ord. 63-1988)
(a) Antique shop
(b) Art and school supply store
(c) Art gallery
(d) Art needlework and hand weaving
(e) Automotive parts supplier provided that no service, repair or installation shall occur on the premises (Ord. 9-1994)
(f) Automotive upholstery shop (Ord. 9-1994)
(g) Barber shop
(h) Beauty shop
(i) Bicycle shops, including rental and repair
(j) Blueprinting and photo stating establishments
(k) Book and stationery store
(l) Camera and photographic supply store
(m) Carpet, rug and linoleum store
(n) Catering establishment
(o) China and glassware shop
(p) Clothing and costume rental store
(q) Coin and philatelic store
(r) Custom dressmaking and millinery store
(s) Denture processing establishments
(t) Drug store
(u) Dry cleaning pick up and/or laundry pick up station
(v) Electrical appliance sales and showroom not including an electrical contractor’s shop
(w) Employment agency
(x) Fabric and yarn shop
(y) Florist shop and greenhouse
(z) Food store, including grocery store, meat market, bakery, candy and ice cream store, delicatessen and frozen food store, including locker rental therewith
(aa) Funeral home
(bb) Garden shop and seed store
(cc) Furniture store
(dd) Furrier shop, including incidental store and conditioning of furs
(ee) Gift shop
(ff) Haberdashery
(gg) Hardware store
(hh) Hobby shop
(ii) Interior decorating shop, including upholstering, making of draperies, slip covers and similar articles
(jj) Jewelry store
(kk) Laboratories, medical, dental, industrial, research, experimental, and testing, (including actual production of experimental and testing purposes only and not for sale or transfer, except that sale or transfer for test marketing purposes shall be permitted), provided there is no danger from fire or explosion nor of offensive noise, vibration, smoke, dust, odors, heat, glare or other objectionable influence. (ll) Laundry and dry cleaning establishments using only coin operated machines. These machines are to be used by the customer or a single employee. The dry cleaning machines are to use only non-flammable, non-explosive solvents and is limited to a steam generator with a maximum of two (2) horsepower capacity. No boiler of any type is permitted and no dry cleaning establishment as described above is to be located in the same building with a residential use.

(aaa) Picture framing establishment, not including the manufacturing of individual frame parts
(bbb) Plumbing showroom, not including a contractor’s shop
(ccc) Printing establishments for letter press, business cards, mimeographing and similar customer services
(ddd) Radio and television service and repair shop
(eee) Restaurant, hotel and/or bar fixture store
(fff) School, including music, dance or business
(ggg) Sewing machine store, household machines only
(hhh) Shoe and hat repair shop
(iii) Sporting goods store
(jjj) Tailor shop
(kkk) Taxidermist shop
(lll) Telegraph office
(mmm) Telephone instrument sales store
(nnn) Tobacco shop
(ooo) Toy shop
(ppp) Travel bureau and transportation ticket office
(qqq) Variety store
(rrr) Wearing apparel shop
154.30.00.04 Bank
Including drive-in banks, savings and loan associates.
154.30.00.05 Parking facility
Public parking areas subject to the provisions of 154.41 and 154.44.
154.30.00.06 Utility
Public utility and public service uses including general offices, garages,
warehouses, bus turn-arounds, fire stations, police stations, public art galleries, railroad facilities, telephone exchanges, water filtration plants, water pumping stations, water reservoirs, electric power substations, and other similar uses except outdoor storage yards. (Ord. 45-1995)
154.30.01 SPECIAL USES
The following uses may be allowed as special uses by ordinance of the Common Council of the City of Richmond, Indiana in accordance with the provisions of Article 48 hereof.
154.30.01.01 General
Any use which may be allowed as a special use in the R-4 District except as modified herein.
154.30.01.02 Eating and drinking place
Restaurants and cafeteria when the food is prepared and intended to be consumed by seated patrons within the principal structure and not including entertainment or dancing or the serving of alcoholic beverages except beer and wine when consumed in conjunction with a meal.
154.30.01.03 Motor vehicle service
Motor vehicle service station subject to the provisions of 154.44.
154.30.01.04 Retail and service
Any retail business or service establishment not a principal permitted use which is determined by the Commission to be of the same general character as one of the principal permitted uses, but not including those uses which are first permitted in the C-2 District, unless demonstrated as necessary for normal day-to-day needs.
154.30.01.05 Development unit projects
Residential and commercial development Unit Projects subject to the provisions of 154.45.
154.30.02 ACCESSORY USES
Accessory uses, buildings or structures customarily incidental to any aforesaid principal or conditional use, shall be permitted in conjunction with such use, including the following:
154.30.02.01 General
Accessory uses permitted and as regulated in the R-4 District.
154.30.02.02 Nonresidential
Accessory uses and structures customarily accessory and incidental to any of the foregoing permitted C-1 non-residential uses and including off-street parking facilities subject to the provisions of 154.41 and business signs subject to the provisions of 154.43.
154.30.03 REQUIRED CONDITIONS
154.30.03.01 Business in enclosed buildings
All businesses, service or processing shall be conducted wholly within a completely enclosed building except for off-street parking; and such outdoor display or storage of vehicles, materials and equipment as may be authorized by the Board.
154.30.03.02 Uses must be non-objectionable
Processes and equipment employed and goods processed or sold shall be limited to those which are not objectionable for any reason of odor, dust, smoke, cinders, gas fumes, noise, vibration, refuse matter or water-carried waste.
154.30.03.03 New merchandise
Goods for sale shall consist primarily of new merchandise.
154.30.04 HEIGHT REGULATIONS
Same as required in the R-4 District.
154.30.05 LOT AREA, FRONTAGE AND YARD REQUIREMENTS
The following minimum requirements shall apply, except as provided in 154.50-154.54.
