154.31 C-2 COMMERCIAL DISTRICT
154.31  C-2 COMMERCIAL DISTRICT (Ord. 59-1981)
 
154.31.00           PRINCIPAL PERMITTED USES
 
                           No building, structure or land shall be erected, altered, enlarged or used which is arranged or designed for other than one of the following uses, except as provided herein and in 154.16.
 
154.31.00.01      General
 
                           Any use as permitted and as regulated in the R-4 and C-1 Districts, except as herein modified.
 
154.31.00.02      Intent
 
                           The C-2 Commercial District is intended to provide for the location of those commercial businesses and services which, because of late hours, the serving of hard liquor, high volume of traffic, live entertainment and other elements, may be considered objectionable when placed in close proximity to a residential transition area.
 
154.31.00.03      Retail and service uses as follows
 
                           These uses may not be substituted one for the other without first obtaining a certificate of occupancy after meeting all minimum ordinance standards.
 
(a)        Ambulance service
 
(b)        Amusement establishments, including bowling alleys, pool halls, dance halls, skating rinks and other similar places of recreation
 
(c)        Auction rooms
 
(d)        Automobile accessory shop
 
(e)        Automobile show rooms, including servicing and repair
 
(f)         Battery and tire service stations
 
(g)        Department store
 
(h)        Dry cleaning cash and carry package plants using non-flammable, non-explosive solvents; and, any boiler used in the processing shall be limited to a fifteen (15) horsepower capacity. This type of dry cleaning establishment shall be limited strictly to over-the-counter service and no dry cleaning establishment as described above is to be located in the same building with a residential use.
 
(i)         Exterminating shops
(j)         Hotel
 
(k)        Laundry, employing not more than four (4) persons in addition to the owner or manager
 
(l)         Liquor stores, package goods only
 
(m)      Motel
 
(n)        Motorcycle show rooms, including servicing and repair
 
(o)        Pawn shop
 
(p)        Restaurants, including live entertainment and dancing and the serving of liquor in conjunction therewith
 
(q)        Secondhand stores and rummage shop
 
(r)        Trailer show rooms, for motor vehicles, including sales, rental, servicing and repair, but not including house trailers, mobile homes or semi-tractor trailers
 
(s)        Mini-Warehouses (Ord. 22-1993)
 
154.31.00.04      Motor vehicle service
 
                           General automobile repair not including major body or fender repairs or the storage or packing of buses subject to the provisions of 154.44.
 
154.31.00.05      Eating and drinking establishment
 
                           Drive-in eating and drinking places, provided the principal building is distance not less than one-hundred (100) feet from any R-District.
 
154.31.00.06      Entertainment
 
                           Night clubs and theatres, but not within one-hundred (100) feet of any R-District and subject to all applicable regulations and such permits as may be required by law.
 
154.31.00.07      School and studio
 
                           Trade schools provided machinery which is used for instructional purposes is not objectionable due to noise, fumes, smoke, odor or vibration; photographic studios, dancing studios, radio and telecasting studios.
 
154.31.00.08      Commercial recreation facility
 
154.31.00.09      Signs
 
                           Subject to the provisions of 154.43.
 
154.31.00.10      Animal hospital, veterinary clinic, etc.
 
                           Animal hospitals, kennels, display and housing or boarding of pets and other domestic animals, provided that any enclosure or building in which animals are kept shall be at least one hundred (100) feet from any R-District and at least fifty (50) feet from any other C-District. Exercise runs shall be enclosed on four (4) sides by an unpierced well-maintained fence or wall at least six (6) feet in height.
 
154.31.00.11      Wood stripping
 
                           The process of utilizing a chemical solvent which has been demonstrated to be non-hazardous by reason of odor, dust, fumes, refuse matter, or air or water carried waste, to remove paint, lacquer, varnish, shellac or other wood finishing material from antiques, household furnishes or other wood pieces.
 
                           Wood stripping may include those services normally considered accessory to a stripping business such as minor repairs, gluing, sanding and hand finishing. (Ord. 38-1983)
 
154.31.00.12      Other
 
                           The uses described in Section 154.30.00.06 of this Code. (Ord. 45-1995)
 
154.31.02           SPECIAL USES
 
                           The following uses may be allowed as special uses by ordinances of the Common Council of the City of Richmond in accordance with the provisions of 154.48 thereof:
 
154.31.02.01      General
 
                           Any use which may be allowed as a special use in the R-4 and C-1 District except as modified herein.
 
154.31.02.02      Retail and service
 
                           Any other retail business or service establishment or use which is determined by the Commission to be of the same general character as the above principal permitted uses, but not including any use which is first permitted or which is not permitted in the C-4 District.
 
154.31.02.03      Motor vehicle service station
 
                           Any motor service station which is determined by the commission to be of the
 
same general character as the above principal permitted uses.
 
154.31.03           ACCESSORY USES
 
                           Accessory uses, buildings or structures customarily incidental to any aforesaid principal or special uses, shall be permitted in conjunction with such use, including the following:
 
154.31.03.01      General
 
                           Accessory uses and structures as permitted and as regulated in the R-4 and C-1 Districts, as well as accessory uses and structures not otherwise prohibited customarily accessory and incidental to any of the foregoing permitted C-2 uses.
 
154.31.04           REQUIRED CONDITIONS - GENERAL
 
                           All conditions as specified for the C-1 District, except for new merchandise in the case of art and antique shops.
 
154.31.05           HEIGHT REGULATIONS
 
                           No principal structure shall exceed four (4) stories of forty-five (45) feet in height and no accessory structure shall exceed two (2) stories or twenty-five (25) feet in height, except as provided in 154.51.
 
154.31.06           LOT AREA, FRONTAGE AND YARD REQUIREMENTS
 
                           The following minimum requirements shall apply, except as provided in 154.50-154.54.
