154.33 C-4 GENERAL BUSINESS DISTRICT
154.33 C-4 GENERAL BUSINESS DISTRICT
 
154.33.00           PRINCIPAL PERMITTED USES
 
                           No building, structure or land shall be erected, altered, enlarged or used which is arranged or designed for other than one of the following uses, except as provided herein and in 154.16.
 
154.33.00.01      General
 
                           Any use permitted and as regulated in the C-3 District except as modified herein and except that no dwellings are permitted
 
154.33.00.02      Wholesale, motor vehicle service excluding motor vehicle service stations, production farm implements, miscellaneous
 
                           The following uses provided that buildings shall be at least fifty (50) feet from any R-District and shall have no openings adjoining any R-District other than stationary windows and fire escapes. (Ord. 2723-1972)
 
(a)        Automobiles, trucks, trailers, farm implements for sale, display, hire, major or minor repair including sales lots, used car lots, trailer lots, body and fender shops, paint shops and bus storage
 
(b)        Battery and tire service stations
 
(c)        Building materials, sales
 
(d)        Commercial greenhouses
 
(e)        Contractor or construction shops, such as: building, cement, electrical, roofing, refrigeration, heating and ventilating, masonry, painting, plumbing, air conditioning
 
(f)         Dry cleaning establishments as major processing plants, provided such an establishment shall be in a completely enclosed building detached from other buildings enclosing different uses. (Ord. 2516-1971)
 
(g)        Frozen food lockers
 
(h)        Garages, model display and sales
 
(i)         House trailer sales
 
(j)         Laundries
 
(k)        Linen, towel, diaper and other similar supply service
 
(l)         Machinery sales
 
(m)      Mail order house
 
(n)        Monument sales
 
(o)        Motorcycle sales, including servicing and repair
 
(p)        Repair of household or office machinery or equipment
 
(q)        Trailers, for motor vehicles, sales and rentals, not including house trailers or mobile homes
 
Production, processing and assembly, relating to the following uses or products: (Ord. 92-1985)
 
(r)       Advertising displays
 
(s)       Art needle-work and hand weaving
 
(t)         Awnings, venetian blinds, window shades
 
(u)        Bakeries, wholesale
 
(v)        Books, hand binding and tooling
 
(w)       Brushes and brooms
 
(x)        Carpenter shops for custom woodworking and custom furniture making
 
(y)        Clothing, custom manufacturing and alterations, for retail only
 
(z)        Cosmetics, drugs and perfumes
 
(aa)      Dentures
 
(bb)      Food processing, packaging and distributing (except meat and fish, sauerkraut, vinegar, yeast and the rendering or refinishing of fats or oils)
 
(cc)      Garages and parking lots, other than accessory, for the storage of motor vehicles including buses and bus bodies (but not truck trailers)
 
(dd)      Glass cutting and glazing
 
(ee)      Jewelry (from precious metals)
 
(ff)        Laboratories, medical, dental, research, experimental, and testing, provided there is no danger from fire or explosion nor of offensive
 
noise, vibration, smoke, dust, odors, heat, glare or other objectionable influence
 
(gg)      Light sheet metal products
 
(hh)      Optical lenses
 
(ii)        Packing and crating
 
(jj)        Printing, commercial, including engraving and photo engraving
 
(kk)      Soldering and welding
 
(ll)        Tool, die and pattern making
 
(mm)   Watches
 
(nn)      Wholesale offices and storerooms with storage
 
(oo)     Die cutting of non-metallic material
 
(pp)     Plastic injection molding, limited to small parts
 
(qq)     Burial casket interior products including but not limited to upholstering and bedding
 
(rr)      Corrugated fiberboard containers
 
(ss)     Electronic components, wiring and assemblies, limited to small parts (Ord. 92-1985)
 
154.33.00.03      Animal hospital, veterinary clinic, etc.
 
                           Animal hospitals, kennels, display and housing or boarding of pets and other domestic animals, provided that any enclosure or building in which animals are kept shall be at least one-hundred (100) feet from any R-District and at least fifty (50) feet from any other C-District. Exercise runs shall be enclosed on four (4) sides by an unpierced well-maintained fence or wall at least six (6) feet in height.
 
154.33.00.04      Bottling works
 
                           Bottling of soft drinks or mild alcohols and distribution stations therefore, providing a building used for such processing and/or distribution shall be at least one-hundred (100) feet from any R-District.
 
154.33.00.05      Signs
 
                           Advertising signs subject to the provisions of 154.43.
 
154.33.00.06      Warehousing storage and trucking terminal
 
                           Warehouses for the storage of merchandise and materials, trucking or motor freight stations or terminals, carting, expressing or hauling establishments, contractor and building material yards, providing no such uses are conducted within two-hundred feet (200) of any R-District.
 
154.33.00.07      Public utility
 
                           Public utility and public service uses including general offices, garages, warehouses, outdoor storage yards, bus turn-arounds, fire stations, police stations, public art galleries, railroad facilities, telephone exchanges, water filtration plants, water pumping stations, water reservoirs, electric power substations, and other similar uses. 154.33.01           SPECIAL USES
 
                           The following uses may be allowed as special uses by ordinance of the CountyCommissioners in accordance with the provisions of 154.48 hereof:
 
154.33.01.01      General
 
                           Any use which may be allowed as a special use in the C-2 District except as modified herein.
 
154.33.01.02      Mobile home parks
 
                           Subject to the provisions of 154.42.
 
154.33.01.03      Other uses
Any other use which is determined by the Commission to be of the same general character as the above permitted uses, but not including any use, which is first permitted in the M-1 District or which is prohibited in the M-1 District.
 
154.33.01.04      Motor vehicle service station
 
                           Any motor service station which is determined by the Commission to be of the same general character as the above permitted uses. (Ord. 2723-1972)
 
154.33.02           ACCESSORY USES
 
                           Accessory uses, buildings or structures customarily incidental to any aforesaid principal or special use, shall be permitted in conjunction with such use, included the following:
 
154.33.02.01      General
 
                           Accessory uses and structures as permitted and as regulated in the C-3 District
and such other accessory uses and structures not otherwise prohibited which are customarily accessory and incidental to any of the foregoing permitted C-4 uses.
 
154.33.03           REQUIRED CONDITIONS
 
                           Processes and equipment employed and goods processed or sold shall be limited to those which are not objectionable by reason of odor, dust, smoke, cinders, gas, fumes, noise, vibration, refuse matter or water-carried waste.
 
154.33.03.01      Closed buildings
 
                           All businesses, services or processing shall be conducted wholly within a completely enclosed building except for the display of merchandise, sale of motor vehicle fuel, lubricants and other fluids at service stations, loading and unloading operations, parking and outdoor display or storage of vehicles, materials and equipment. Except that the outdoor display of merchandise and the outdoor display or storage of vehicles, materials and equipment when located within one thousand (1000) feet of a C-3 Zoning District shall be permitted only through the authorization of the Board of Zoning Appeals. (Ord. 32-1983)
 
154.33.03.02      Night operation
 
                           No building customarily used for night operation, such as a bakery or milk bottling and distribution station, shall have any opening, other than stationary windows or required fire exits, within one hundred (100) feet of any R-District, and any space used for loading or unloading commercial vehicles in connection with such an operation shall not be within one hundred (100) feet of any R-District.
 
154.33.04           PROHIBITED USES
 
154.33.04.01      Dwellings, etc.
 
                           Dwellings and residences of any kind, except mobile home parks, schools, hospitals, clinics, and other institutions for human care, except where incidental to a permitted principal use; provided, however, that any of the aforesaid uses legally existing in the C-4 District at the time of the adoption of this ordinance or any amendment thereto, shall not be classified as a nonconforming use.
 
154.33.04.02      Offensive uses - Not to be authorized
 
                           No use shall be permitted or authorized to be established or maintained which, when conducted under adequate conditions and safeguards, in compliance with the provisions of this Ordinance and any additional conditions or requirements prescribed by the Commission is, or may become, dust, smoke, cinders, gas, fumes, noise, vibration, heat frequency, refuse matter or water-carried waste.
 
154.33.05           HEIGHT REGULATIONS
 
                           Same as required in the C-2 District.
 
154.33.06           LOT AREA, FRONTAGE AND YARD REQUIREMENTS
 
                           The following minimum requirements shall be observed, except as provided in 154.50-154.54. (Ord. 35-1978)
