154.46 SWIMMING POOLS
154.46.00 DEFINITION
A swimming pool as regulated herein shall be any pool, lake or open tank other than a farm pond or a stock tank, not located within a completely enclosed building, and containing or normally capable of containing water to a depth at any point greater than one and one-half (1 1/2) feet. No such swimming pool shall be constructed or operated in any district, whether as an accessory use or as a principal use, unless it complies with the following conditions and requirements.
154.46.00.01 Neighborhood, club or public pool
Any such swimming pool in any district may not be located within less than two hundred (200) feet of any other lot in any R-District, and shall meet the requirements of 154.46.03 through 154.46.06.
154.46.01 EXCLUSIVE PRIVATE USE IN AN R-DISTRICT
If located in any R-District, the pool shall be intended and used solely for the enjoyment of the occupants of the principal building of the property on which it is located and their guests or for the enjoyment of bona fide members of a club and their guests.
154.46.02 DISTANCE REQUIREMENTS
The pool may be located anywhere on the premises except in required front yards, provided it shall not be located closer than ten (10) feet to any property line of the property on which located; and, provided that pump and filter installations shall not be located closer than twenty (20) feet to any such property line.
154.46.03 FENCING
The swimming pool, or the entire property on which it is located, shall be so walled or fenced as to prevent uncontrolled access by children from the street or from adjacent properties.
154.46.04 DRAINAGE
Adequate provision for drainage shall be made subject to approval by the City Engineer.
154.46.05 LIGHTING
Any lighting used to illuminate the pool area shall be so arranged as to deflect the light from adjoining properties.
154.46.06 PERMIT REQUIRED
No person, firm or corporation shall construct or install a swimming pool or make any alteration thereon or in the appurtenances thereof without having first obtained an Improvement Location Permit for such construction, installation or alteration.
154.46.07 FARM POND OR STOCK TANK
For the purpose of this Article a farm pond or a stock tank shall not be considered to be a swimming pool. However, if such an installation is used for commercial recreational purposes, then it shall be classified as a swimming pool and the above regulations shall apply.
