154.60.03 CERTIFICATE OF OCCUPANCY
154.60.03           CERTIFICATE OF OCCUPANCY
 
154.60.03.01      Required for all new and altered buildings and land uses
 
                           It shall be unlawful for any owner, lessee or tenant to occupy, use or to permit the use of any structure, building, or part thereof, hereafter created, erected, changed, converted or enlarged, wholly or partly, or of any land when no building or structure is involved, until a Certificate of Occupancy shall have been issued by the Zoning Inspector, after inspection. Such certificates of Occupancy shall show and certify that such building, structure or premises, or part thereof, and the proposed use thereof are in conformity with the provisions of the Ordinance, the building codes and all other applicable codes or ordinances and all conditions and requirements, if any stipulated by the Board of Appeals or other property authority.
 
154.60.03.02      New buildings and alterations
 
                           A Certificate of Occupancy for a building hereafter erected, constructed, reconstructed, converted or otherwise altered, shall be applied for coincident with the application for an Improvement Location Permit, and shall be issued within ten (10) days after the erection or alteration of such building shall have been completed in conformity with the provisions of this Code.
 
154.60.03.03      Change in use of buildings or land
 
                           A Certificate of Occupancy for a change in use of a building, or land shall be applied for before any such a building or land shall be occupied or used, and a Certificate of Occupancy shall be issued within ten (10) days after application has been made, provided such use is in conformity with all the provisions of this Ordinance.
 
154.60.03.04      Records and copies
 
                           A record of all Certificates of Occupancy shall be kept on file in the office of the Zoning Inspector, and copies shall be furnished on request to any person having a property or tenancy interest in land or a building affected.
 
154.60.03.05      Nonconforming use
 
                           A Certificate of Occupancy shall be required for each nonconforming use existing at the time of passage of this Ordinance or which may be created through any amendment thereto. Application for such Certificate of Occupancy for a nonconforming use shall be filed with the Zoning Inspector by the owner or lessee of the building or premises occupied by such nonconforming use within one (1) year from the date said use becomes nonconforming through the enactment of any amendment thereto. It shall be the duty of the Zoning Inspector to issue a Certificate of Occupancy for the nonconforming use upon such application, but failure to obtain such Certificate of occupancy within said one (1) year from said date shall create a conclusive presumption that such nonconforming use did not exist prior to the effective date of this Ordinance or of an amendment thereto, as the case may be.
