154.61.01 JURISDICTION COMPOSITION AND APPOINTMENT
154.61.01           JURISDICTION COMPOSITION AND APPOINTMENT
 
                           The Advisory Board of Zoning Appeals of Richmond shall have full jurisdiction over all the land subject to the Zoning Ordinance of the city of Richmond, Indiana and full jurisdiction of the subject matter provided for in the Zoning Ordinance. The board shall be composed of five (5) members who shall be appointed in the following manner:
 
154.61.01.01      One (1) citizen member appointed by Common Council.
 
154.61.01.02      Three (3) citizen members appointed by the Mayor of the City of Richmond, of whom one (1) must be a member of the Richmond City Plan Commission.
 
154.61.01.03      One (1) citizen member appointed by the Richmond City Plan commission who must be a member of the Plan Commission other than the member appointed by the Mayor.
 
154.61.01.04      If the Richmond City Plan Commission exercises jurisdiction outside the unincorporated area of the City, the Richmond City Plan Commission shall designate, as its appointment to the Board one (1) of the two (2) members appointed to the Plan commission to represent the unincorporated area. This citizen member of the board must reside in the unincorporated area and shall be appointed to a term of four (4) years.
 
154.61.01.05      All Board members shall be residents of the jurisdictional area of the Board, none of whom may hold other elective or appointive office, except that two (2) of the five (5) shall be appointed from the membership of the Richmond City Plan Commission.
 
154.61.01.06      Upon the establishment of the Advisory Board of Zoning Appeals, the members shall initially be appointed for the following terms of office:
 
(a)        The Common Council shall appoint one (1) member for the initial term of one (1) year.
 
(b)        The Mayor shall appoint one (1) member from the Plan Commission for the initial term of two (2) years.
 
(c)        The Mayor shall appoint one (1) member for the initial term of three (3) years.
 
(d)        The Mayor shall appoint one (1) member for the initial term of four (4) years.
 
(e)        The Richmond City Plan Commission shall appoint from its membership one (1) member for the initial term of four (4) years.
 
154.61.01.07      Each term expires on the first Monday of January of the first, second, third, or fourth year, respectively, after the year of the member’s appointment. When an initial term of office expires, each new appointment is for a term of four (4) years.
 
154.61.01.08      The appointing authority may remove a member from the Board for a cause. The appointing authority must mail notice of the removal, along with written reasons for the removal to the member at his residence address. A member who is removed may, within thirty (30) days after receiving notice of the removal, appeal the removal to the CircuitSuperiorCourtofWayneCounty.
 
154.61.01.09      If a vacancy occurs among the members of the board, the appointing authority shall appoint a member for the unexpired term of the vacating member. In addition, the appointing authority may appoint an alternate member to which the regular member it has appointed has a disqualification as described below.
 
154.61.01.10      A member of the Advisory Board of Zoning Appeals may not participate in a hearing or decision of that Board concerning a zoning matter in which he has a direct or indirect financial interest. The board shall enter in its records:
 
(a)        The fact that a regular member has such a disqualification; and
 
(b)        The name of the alternate member, if any, who participate in the hearing or decision in place of the regular member.
